Daikin workers continue their struggle

The Gurgaon-Manesar-Bawal-Tapukera-Neemrana belt which is part of the DMIC (Delhi Mumbai Industrial Corridor) zone is  continuing to witness  sustained struggles by the workers of Honda (Tapukeraneemrana2) and Daikin (Neemrana). Both of these factories are in Alwar district in Rajasthan, a state which has taken front seat in embracing labour law reforms.

In both factories, workers are fighting for union formation (which involves all the workers employed in their factory) and against persecution by the state-management nexus.
Daikin workers have been fighting to have their union (under AITUC) recognized for past three years. (For more on their struggle, see here). As the management has stopped the unionization for the past three years using an interim injunction, workers decided to file an application for a new independent union. Due to this, management has started to threaten the workers . One of the applicants in the union registration was pressurized to withdraw his signature. He posted about the management’s pressuring tactic on whatsApp, following which the management promptly him on 21st October.neemrana3

Workers from both shifts struck work demanding reinstatement of suspended workers. They  stopped production till late night  on Friday (21st October) as the management refused to resolve the issue. More than 1000 workers of both shifts stayed back inside the plant , while outside there was heavy police presence and a tense atmosphere prevailed.  Ultimately the workers left the plant at 4 am on Saturday morning after the local administration intervened and there were promises of settlement of the issue in a tripartite meeting on 22nd.

But  on 22nd,  the management accompanied by the local administration, police and labour commissioner, came prepared. They refused to engage with the workers’ demands, accused the workers of damaging machines, threatened the workers of further actions on Monday and termination of all 51 workers who signed in the registration of union. They also accused the workers of creating ‘trouble’ in other companies in the industrial belt, and repeatedly mentioned Honda workers issue.
It should be noted that during the ongoing Honda struggle, Daikin workers as well as other workers from Neemrana Mazdoor Union have shown remarkable solidarity with Honda workers not just by their presence but also by offering crucial financial support.  These two simultaneous and protracted struggles have drawn workers from Honda and Daikin  closer. Honda workers have expressed solidarity with striking Daikin workers by joining them in their struggle and demonstrations.

After the talks on Saturday failed, Daikin along with  workers from other plants in Neemrana gave a call for protest rally in Ambedkar Bhavan on Saturday. As per the press note released by the workers of Daikin, this was enough to scare the management and they again called workers for a meeting which was mediated by officials from Neemrana administration. During this meeting it was decided that  the a procedure to take back suspended workers will begin in the earnest. Management also promised that no enquiry will be conducted on any of the other workers and if any worker is suspended, it will first be informed to the Neemrana administration.

After this meeting and successful negotiation, workers returned to work on Monday . But as they note in the press statement, they fear that as soon as Diwali ends,   management might try  to take some vindictive action against the workers. The workers also warn the management  that if the suspended worker is not taken back, they will not hesitate to escalate the struggle. During the Sunday meeting the workers informed both Daikin Management and Neemrana administration that they are ready to resolve any issue primarily through dialogue .

As the workers predicted in their press note,  management seems to prepare for further attack soon and has given charge sheet to four worker leaders on 25th. Workers are preparing to respond to this onslaught by management and have contacted Honda and  workers  from other factories to forge a regional unity.

डाईकिन प्रबंधन के साथ मजदूरों की वार्ता सफल
नीमराणा :- डाईकिन एयरकंडीशनिंग नीमराणा में मजदूरों की मांग के आगे झुकते हुए प्रबंधन शुक्रवार को निलम्बित हुए श्रमिक को वापस लेने की प्रक्रिया शुरू करने पर राजी हो गया है। शुक्रवार को इस निलंबन की घटना के ख़िलाफ़ मजदूरों ने टूल डाउन कर विरोध जताया था। शनिवार को स्थानीय प्रशासन और लेबर डिपार्टमेंट की मध्यस्तता में चली वार्ता विफल हो गयी जब प्रबधंन ने अड़ियल रूख अपनाते हुए श्रमिक का निलंबन वापस लेने से इन्कार करते हुए उल्टा और भी मजदूरों को निलंबित करने की धमकी दी थी। इससे डाईकिन तथा अन्य प्लांटों के मजदूरों में रोष व्याप्त था और विरोध स्वरूप डाईकिन के मजदूरों ने रविवार को अम्बेडकर पार्क नीमराणा में  रैली और सभा का आह्वान किया था। मजदूरों के इस आक्रामक रूख से स्थानीय प्रशासन और डाईकिन प्रबंधन परेशान हो सकते में आ गए। इस रैली के घोषणा के बाद प्रबंधन रविवार को सुबह 11 बजे नीमराणा प्रशासन की मध्यस्था में मजदूरों से वार्ता करने को तैयार हो गया। वार्ता के दौरान यह तय हुआ कि निलम्बित श्रमिक को वर्तमान केस में चार्जशीट देकर निलम्बन वापस लेने की प्रक्रिया  होगी ।अन्य किसी श्रमिक पर कोई कार्यवाही नहीं होगी। प्रबंधन अगर किसी श्रमिक को विकटिमाईज करता है तो उसकी सूचना पहले स्थानीय प्रशासन को देनी होगी। सोमवार से गतिरोध समाप्त करते हुए सभी श्रमिक अपनी शिफ्ट में काम पर वापस लौट जायेंगें। प्रबंधन के पुराने तौर तरीकों को देखते हुए मजदूरों में यह रोष मौजूद है कि दीपावली के बाद प्रबंधन मजदूरों के ख़िलाफ़ दुर्भावनावश कोई भी दमनात्मक कदम उठा सकती है। इस बात को लेकर सभी मज़दूर सतर्क है। अगर प्रबंधन निलंबित श्रमिक को वापस नहीं लेता तो मज़दूर आगे कोई बड़ा कदम उठा सकते है। डाईकिन के मजदूरों ने स्थानीय प्रशासन और प्रबंधन को स्पष्ट कर दिया कि प्राथमिक तौर किसी भी समस्या को वो बातचीत के जरिये सुलझाने के लिए तैयार हैं। वार्ता के दौरान स्थानीय प्रशासन की ओर से तहसीलदार नीमराणा, एस डी एम नीमराणा तथा डी एस पी नीमराणा, प्रबंधन की ओर से कंपनी प्रबंधक पंकज दीवान और मज़दूर प्रतिनिधी मौजूद थे।
